AI vendors can potentially qualify as school officials if the institution designates them as such in its FERPA policy, the vendor performs services the institution would otherwise perform, the vendor is under the direct control of the institution regarding use of records, and the vendor doesn't re-disclose records without authorization. Ensure AI vendor contracts include FERPA-compliant provisions addressing all these requirements.
Directory Information Considerations: While FERPA allows disclosure of "directory information" without consent, institutions should consider whether AI tools need access to even this category. Student names, email addresses, and enrollment status used in AI tools could be combined with other data to create privacy concerns beyond directory information scope.
Parent and Student Rights: FERPA grants rights to parents (and students over 18) to access and control education records. Institutions must be able to explain how AI processes student data, provide access to AI-maintained records upon request, honor requests to amend incorrect AI-processed records, and disclose AI processing in annual FERPA notifications.
De-Identification Requirements: FERPA allows disclosure of de-identified data for research and analysis. When using student data with AI tools, proper de-identification requires removing all direct identifiers and ensuring re-identification is not reasonably possible. Be cautious — AI tools can potentially re-identify individuals from seemingly de-identified datasets.
